1. Definitions
Capitalized terms have the meanings set forth in Exhibit “A” (Definitions) at the end of these Terms of Service.
2. Acceptance
a. By accessing, purchasing, or using any services, products, content, websites, applications, integrations, workout charts, downloadable materials, or training resources provided by Outright Fitness LLC (“Outright Fitness,” “we,” “us,” or “Vendor”), including Trainerize-based training access, digital workouts, PDF products, physical workout wall charts, laminated compact workout charts, product bundles, QR-accessed exercise demo videos, and any associated websites, landing pages, forms, or widgets (collectively, the “Services”), you agree to be bound by these Terms of Service and our Privacy Policy located at https://outrightworkoutlibrary.com/privacy-policy/ (collectively, the “Terms”).
b. You represent and warrant that you are at least 18 years old or the age of majority in your jurisdiction and have the legal authority to enter into these Terms. If you purchase or use our Services on behalf of a minor, child, athlete, student, family member, team, school, organization, or client, you are responsible for supervising appropriate use and ensuring the Services are suitable for that individual’s needs, ability level, and health status.
c. We may update these Terms at any time. The most current version will be available at https://outrightworkoutlibrary.com/legal. Your continued use of the Services after updates constitutes acceptance of the updated Terms.
d. If you do not agree to these Terms, do not use the Services or purchase our products.
3. Health Disclaimers and Assumption of Risk
a. Not Medical Advice. The Services and Content are provided for educational and informational purposes only and are not medical advice. This includes app-based workouts, PDF programs, workout wall charts, laminated compact workout charts, QR exercise demo videos, written instructions, coaching cues, and any other training-related materials. Always consult a qualified physician or healthcare provider before beginning any exercise program, nutrition plan, or making changes to medical treatment.
b. Emergency. If you have an emergency, urgent health concern, or need medical advice, stop using the Services and contact your physician or emergency services immediately.
c. Assumption of Risk. Physical activity and exercise involve inherent risks of injury, illness, or other harm. You voluntarily assume all risks associated with your participation and use of the Services, including any use of workout charts, compact charts, QR demo videos, app-based workouts, PDF programs, or interaction with trainers or support staff.
d. Use Proper Judgment. You are responsible for choosing exercises, workouts, loads, intensity levels, equipment, and modifications that are appropriate for your current fitness level, age, health status, environment, and available supervision. Stop exercising if you feel pain, dizziness, shortness of breath, chest discomfort, or any unusual symptoms.
e. No Guarantees. Results vary. We do not guarantee any specific outcomes related to strength gains, fat loss, athletic performance, coordination, endurance, mobility, injury prevention, or health improvements.
4. License to Use the Services
a. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services and Content for your personal, non-commercial use.
b. Purchasing a physical product, such as a workout wall chart, laminated compact workout chart, poster, booklet, journal, or product bundle, gives you ownership of that physical item only. It does not transfer ownership of the underlying workout programming, exercise organization, written content, images, graphics, videos, QR-linked resources, brand assets, or intellectual property.
c. All rights, title, and interest in and to the Services, Content, workout systems, product designs, layouts, written materials, videos, graphics, trademarks, and related intellectual property are owned by Outright Fitness or its licensors. We reserve all rights not expressly granted.
5. Accounts, Access IDs, QR Codes, and User Responsibilities
a. You may be required to create an account, receive Access IDs, scan QR codes, or access private or unlisted links to use parts of the Services. You agree to provide accurate, complete, and current information and to update it as needed.
b. You are responsible for maintaining the confidentiality and security of your Access IDs, account information, private access links, and any other access credentials provided to you. Notify us promptly of any unauthorized access or suspected security breach.
c. You agree not to share, sell, transfer, publish, scrape, copy, mass distribute, or otherwise provide your account, Access IDs, QR-linked video pages, private links, downloadable materials, or restricted access materials to others, except where explicitly permitted by us in writing.
d. Some physical products may include QR codes or web links that provide access to exercise demonstrations, coaching videos, follow-along videos, or related instructional resources. These resources are intended to support your use of the purchased product and may be hosted on third-party platforms or Outright Fitness websites.
e. We may update, replace, reorganize, move, restrict, or discontinue QR-linked or web-linked content at any time. We make reasonable efforts to keep product support resources available, but we do not guarantee that every link, QR code, third-party video, or digital support resource will remain available indefinitely.
6. Purchases, Payment Processing, and Third-Party Checkouts
a. Payments may be processed by third-party payment processors depending on the offer and checkout you use. Some pages or offers may process payments through ClickBank, while other purchases on our websites may be processed through Stripe and/or PayPal (collectively, “Payment Processors”).
b. Your purchase may be subject to the Payment Processor’s terms, refund policies, dispute processes, and billing descriptors. We are not responsible for the acts, omissions, processing delays, charge errors, or technical issues of Payment Processors.
c. By submitting payment information, you authorize applicable charges and agree to pay all fees, taxes, shipping charges, and other charges associated with your purchase.
d. Product descriptions, images, pricing, availability, formats, and included features may change from time to time. We make reasonable efforts to accurately describe our products, but minor variations in printed materials, packaging, colors, finishes, sizing, or product presentation may occur.
7. Subscriptions, Trials, and Billing (If Applicable)
a. Some offerings may be sold as subscriptions, while other offerings are one-time purchases. If a subscription applies, it will renew automatically unless you cancel before your next billing date.
b. Trial periods, if offered, may convert to a paid subscription unless cancelled before the trial ends. Trial length and eligibility may vary by offer.
c. You are responsible for managing your subscription, including cancellation, through your account portal where available. Accounts are self-managed.
d. If payment fails, we may suspend or terminate access until payment is successfully processed.
8. Refunds, Returns, Shipping, and Physical Product Issues
a. Refund eligibility, if any, depends on the specific offer, product type, and checkout used. Refunds may also be governed by the applicable Payment Processor’s refund policies, including ClickBank’s policies when ClickBank is used.
b. Digital downloads, including PDFs, app-based access, downloadable files, workouts, and programs may be non-refundable or may be excluded from certain guarantees due to instant electronic delivery. Where a guarantee is offered, the guarantee terms will be described on the applicable sales page, checkout page, or order confirmation.
c. Physical products, including workout wall charts, laminated compact workout charts, posters, booklets, journals, product bundles, and other merchandise, may be eligible for return according to our Refund Policy and Return Policy requirements.
d. Shipping times are estimates and may vary due to carrier delays, weather, holidays, incorrect addresses, or other circumstances outside of our control. Customers are responsible for providing complete and accurate shipping information at checkout.
e. If your physical order arrives damaged, defective, incorrect, or appears to be missing, contact us as soon as possible with your order number and photos where applicable. Shipping-related issues should be sent to shipping@outrightworkoutlibrary.com.
f. To request support with a refund or return question, please contact us at support@outrightworkoutlibrary.com. If your purchase was processed by ClickBank or a third-party marketplace, you may also need to submit your request through that processor’s or marketplace’s support/refund process.
9. Third-Party Marketplace Purchases
a. Some Outright Fitness products may be sold through third-party marketplaces or retailers, such as Amazon, Walmart, Etsy, or other sales channels.
b. If you purchase through a third-party marketplace, your order, payment, shipping, returns, refunds, customer reviews, and related support may be governed by that marketplace’s policies and procedures.
c. We are not responsible for marketplace-specific delays, return decisions, refund processing, account issues, review moderation, listing changes, or other actions taken by third-party marketplaces.
d. If you need help identifying the correct support channel for a marketplace purchase, contact us and we will do our best to point you in the right direction.
10. Content, Intellectual Property, and Usage Restrictions
a. The Services may include workout plans, programming, exercise systems, written materials, PDFs, videos, QR-linked video demos, follow-along videos, text, graphics, charts, posters, laminated compact charts, product layouts, product images, and other content (“Content”). Content is provided for your personal use only unless we provide written permission otherwise.
b. You may not copy, reproduce, distribute, sell, resell, license, share, publicly display, publicly perform, upload, scan, digitize, modify, create derivative works from, reverse engineer, or otherwise exploit the Services or Content without our prior written permission.
c. You may not reproduce, photograph, scan, upload, distribute, or resell our workout charts, compact charts, PDFs, posters, videos, or other materials as your own product, digital download, coaching resource, class handout, online course, printable, marketplace listing, social media content, or commercial training material without our prior written permission.
d. Trainers, coaches, teachers, schools, gyms, teams, and organizations may use purchased physical products as visual reference tools in their own facility, classroom, gym, home, or training environment. However, this does not permit copying, redistributing, digitizing, reselling, or creating competing products from our Content.
e. You may not use the Services to harass, abuse, harm others, violate laws, send spam, run misleading marketing, or misrepresent your affiliation with Outright Fitness.
f. We may host or deliver video content through third-party platforms, including YouTube. By using the Services, you agree to comply with YouTube’s Terms of Service and applicable third-party terms.
g. We may use third-party automation, ecommerce, shipping, email, and integration tools, including Zapier, WooCommerce, Constant Contact, shipping providers, and other business tools, to help deliver access, process orders, provide support, and communicate with customers. Use of such tools does not change your obligations under these Terms.
11. User Content
a. If you submit, upload, or share content through the Services, including reviews, testimonials, messages, photos, videos, support requests, form submissions, or other materials (“Your Content”), you retain ownership of Your Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and use Your Content solely to operate, provide, support, market, and improve the Services, subject to applicable law and our Privacy Policy.
b. You represent that you have all rights necessary to upload or share Your Content and that doing so does not violate any laws or third-party rights.
c. If you submit a testimonial, review, photo, or success story, we may request additional permission before using it in marketing materials where required or appropriate.
12. Service Availability, Updates, and Changes
a. We may modify, update, suspend, or discontinue any part of the Services at any time, including features, pricing, product formats, QR-linked resources, video access, downloadable materials, physical product availability, and training content.
b. The Services may occasionally be unavailable due to maintenance, updates, technical issues, third-party platform changes, carrier issues, or factors outside our control.
c. We may update workout content, exercise names, videos, instructions, layouts, and product support resources over time to improve clarity, usability, or customer experience.
13. Termination and Suspension
a. We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or for any lawful reason.
b. You may stop using the Services at any time. If you have an active subscription, you must cancel it through your account portal where available to stop future billing.
c. Termination of digital access does not affect intellectual property restrictions, payment obligations, refund limitations, disclaimers, limitations of liability, or any other provisions intended to survive termination.
14. Warranty Disclaimer
THE SERVICES, PRODUCTS, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES, PRODUCTS, CONTENT, QR CODES, VIDEOS, LINKS, OR THIRD-PARTY PLATFORMS WILL BE UNINTERRUPTED, ERROR-FREE, AVAILABLE INDEFINITELY, OR THAT DEFECTS WILL BE CORRECTED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTRIGHT FITNESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, PHYSICAL CONDITION, TRAINING RESULTS, OR PRODUCTIVITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, PRODUCTS, OR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES OR PRODUCT AT ISSUE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
16. Indemnification
You agree to indemnify, defend, and hold harmless Outright Fitness and its owners, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use of the Services, Products, or Content; (b) your participation in exercise or training activities; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) Your Content.
17. Affiliate Program Terms
a. To join our affiliate program, you must be at least 18 years old and have an active affiliate account where applicable.
b. Commission rates, eligibility, cookie windows, payout timing, thresholds, and related terms may be provided through the affiliate dashboard or official program materials and may change at any time.
c. Affiliates must comply with all applicable laws and advertising regulations and must not engage in spam, deceptive practices, false claims, misleading health or fitness claims, unauthorized discounting, or unauthorized use of Outright Fitness branding.
d. Affiliates may not make claims about guaranteed weight loss, guaranteed performance results, medical outcomes, injury prevention, or health benefits unless such claims are expressly approved by us in writing and properly substantiated.
e. We may review, suspend, withhold payments, or terminate affiliate participation at any time for suspected fraud, policy violations, chargeback abuse, unethical conduct, misleading advertising, or violations of these Terms.
18. Dispute Resolution and Governing Law
a. These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
b. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction and venue in those courts.

EXHIBIT “A” — DEFINITIONS
“Access IDs” means the unique identification names, login credentials, passwords, access links, QR-linked access points, or other credentials assigned or made available to a user to access the Services, and “Access ID” shall be construed accordingly.
“Agents” means a party’s agents, employees, consultants, contractors, and/or other authorized representatives, and “Agent” shall be construed accordingly.
“Content” means any material made available through the Services or included with Products, including without limitation data, information, text, graphics, photos, videos, QR-linked materials, workout charts, posters, PDFs, exercise demonstrations, written instructions, layouts, programming, and other materials.
“Payment Processors” means third-party payment processing providers used to process transactions for the Services or Products, which may include ClickBank, Stripe, and PayPal depending on the offer and checkout.
“Products” means physical or digital products offered by Outright Fitness, including workout wall charts, laminated compact workout charts, posters, booklets, journals, product bundles, PDFs, app-based workouts, downloadable files, and other training-related products.
“Services” means the services, products, content, websites, applications, digital resources, physical products, Trainerize-based app access, QR-linked resources, and any website, application, landing page, form, or widget associated therewith, as modified by Outright Fitness from time to time.
“you,” “your,” and/or “yourself” means the person accessing, purchasing, or making use of the Services or Products.
“Your Content” means Content posted, submitted, uploaded, displayed, messaged, emailed, reviewed, or otherwise provided on or through the Services by you.

Our services may include embedded videos, QR-linked videos, exercise demo videos, follow-along videos, or other video content hosted through YouTube, Google, or similar third-party platforms.

If our services use YouTube API Services, your use of those features may also be subject to YouTube’s Terms of Service and Google/YouTube API policies. YouTube’s Terms of Service are available at https://www.youtube.com/t/terms.

Outright Fitness LLC offers digital products, app-based workouts/programs, downloadable PDFs, and physical workout products, including workout wall charts, double-sided laminated compact workout charts, product bundles, posters, booklets, journals, and other fitness-related merchandise. This Refund Policy explains what is and is not eligible for refunds.
1) Digital Products (App Access, Workouts/Programs, PDFs)
All PDF downloads are non-refundable. Because PDFs are delivered electronically and can be downloaded, saved, or printed after purchase, we cannot offer refunds for PDF purchases once delivered.
App-based products and access, including training app access, workouts, programs, and other digital training resources, are also generally non-refundable once access has been delivered.
In rare cases where we confirm that you could not access the app or digital product due to a verified technical issue on our side, we may provide an alternative solution at our discretion, such as troubleshooting support, restored access, or a PDF version of the same product where applicable.
Important note about ClickBank: Some purchases may be processed through ClickBank. In those cases, refund requests may be handled through ClickBank’s refund process and policies in addition to this policy.
2) Subscriptions (If Applicable)
Some offerings may be sold as subscriptions. All accounts are self-managed. You can log in at any time to update or cancel your subscription to avoid future charges.
We do not provide refunds for unused subscription periods or for failure to cancel before the next billing date.
3) Physical Products (Workout Charts, Posters, Bundles, and Merchandise)
For physical products purchased directly from Outright Fitness / Outright Workout Library, we offer a standard 30-day return policy from the date your order is delivered.
This includes eligible physical products such as:

- Workout chart bundles
- Posters
- Booklets
- Journals
- Other physical fitness-related merchandise
To be eligible for a return:
- The item must be returned within 30 days of delivery.
- The item must be in new, unused condition.
- Workout charts, laminated compact charts, posters, and printed materials must not be written on, damaged, bent, torn, stained, heavily handled, or altered.
- The item must be returned in its original packaging where applicable.
- You must provide proof of purchase, such as an order number or receipt.
Non-returnable items:
- Digital products, including PDFs, app access, downloadable files, workouts, and programs
- Items marked “final sale”
- Gift cards, if offered
- Physical products that have been used, damaged by the customer, written on, altered, or returned outside the 30-day return window

4) Third-Party Marketplace Purchases

AFFILIATE PROGRAM TERMS

Overview
This agreement is between you (“Affiliate”) and Outright Fitness LLC (“Outright Fitness”).
By joining the Affiliate Program, you agree to the terms below.
We may update these terms from time to time. You’ll be notified by email if changes occur.
How It Works
As an approved affiliate, you can promote Outright Fitness App products and earn commissions in two ways:
- Referral Link: Share your unique affiliate link anywhere (social media, email, blog, etc.).
• Commissions are calculated on the full product price of any purchase made through your link. - Coupon Codes: Coupon codes can be created and assigned to you.
• When customers use your code, they receive a discount.
• Your commission is calculated on the discounted product price.
• You’ll receive an email notification whenever a new coupon code is issued to you.
Access your {affiliate_dashboard_link} to copy your link, manage coupon codes, and track clicks, sales, and commissions.
Commission & Payments
- Standard commission rate: {affiliate_rate} (unless exceptions are listed in the Affiliate Dashboard).
- Commissions apply to the first purchase only (not recurring orders unless otherwise stated).
- Payments are made after the refund/locking period and require valid tax/payment details in your Affiliate Dashboard.
- You are responsible for reporting and paying any taxes due on your commissions.
Program Rules
- No self-referrals — you may not use your own link or code to purchase products for yourself.
- No misleading advertising or unauthorized use of Outright Fitness trademarks.
- No PPC bidding on our brand name or creating fake/misleading social media accounts.
- You must comply with all laws, including CAN-SPAM and FTC disclosure guidelines when promoting affiliate links or codes.
Termination
Either you or Outright Fitness may end this agreement at any time.
Upon termination, you must stop using your affiliate link, coupon codes, and any Outright Fitness branding.
Liability
Our liability to you is limited to the commissions you’ve earned in the 12 months before any claim.
We make no guarantees regarding sales, performance, or availability of the Affiliate Dashboard.
Governing Law
This agreement is governed by the laws of Texas, USA.
Any disputes will be resolved in Austin, Texas.
By participating in the Affiliate Program, you confirm that you’ve read and agree to these terms.

Commission Summary
- Affiliate Links: Earn commission when a customer makes a purchase after clicking your unique link.
- Coupon Codes: If a customer uses your assigned coupon code, you earn commission on that discounted sale.
- Persistent Commissions: After a customer’s first purchase through your link or coupon, you continue to earn a smaller commission (as shown in your dashboard) on their future purchases.
Your commission rates (initial and persistent) are always displayed in your Affiliate Dashboard.
Limitations
- Commissions apply only to new customers’ first purchase unless persistent commissions are noted in your dashboard.
- Customers must remain active after the free trial period for commissions to apply.
- Affiliate tracking depends on cookies. If a customer clears cookies or uses another device/browser, tracking may be lost.
- Attribution is “last click wins.” If multiple affiliates refer the same customer, the last affiliate link clicked gets credit.
- No commission is paid on upgrades, downgrades, or your own purchases.
Promoting Outright Fitness
- Branding: Always write “Outright Fitness” as one word. Use official logos and materials only as provided.
- Prohibited:
- No false or misleading claims (e.g., “Lose 30 lbs in 30 days”).
- No altering logos or creating custom branded graphics without approval.
How to Identify Yourself
- Do: Call yourself an “Outright Fitness Affiliate” or “Affiliate Marketer.”
- Do Not: Call yourself a “Partner” or imply an official partnership.
Advertising Rules
- You may not buy ads on Outright Fitness branded terms (e.g., “Outright Fitness,” “Outright Fitness App”).
- If you run ads, they must link to your own site or content—not directly to outrightworkoutlibrary.com.
Other Policies
- You may be asked to show where you share affiliate links (website, email, social media, etc.).
- You cannot earn commission on your own purchases.
- You must follow FTC rules by disclosing that you may earn commissions when sharing your links.
Program Details
- Commission rates and structures are listed in your Affiliate Dashboard and may change at our discretion.
- Payments follow the schedule and methods outlined in the Affiliate Program Agreement.
- We reserve the right to end the affiliate relationship at any time as outlined in the Agreement.
